Terms of Use for Autoškola Professional

1. Scope and formation of the agreement
The licence to the app is governed by Apple’s standard End User License Agreement (EULA). These Terms supplement information about the provision of educational content, subscriptions and support; they do not replace the standard EULA. In the event of a conflict concerning the scope of the licence, the standard EULA takes precedence. Mandatory consumer rights remain unaffected.
These Terms govern the use of the app and its digital content. The app is intended for distribution and use in the Czech Republic; the contractual language is Czech.
The agreement for free use is formed when the user accepts the Terms. Paid provision is agreed when the purchase is confirmed in the Apple App Store. The current Terms remain available in the app. The app locally records the version and time of acceptance; Apple also maintains the purchase history in the user’s account.
Relationship to the original Windows software
Autoškola professional for iPhone and iPad is a separate product distributed through the App Store. It is not included in the licence or update subscription for the original Windows software of the same name. Purchasing the original software does not in itself unlock Premium in this app; purchases in this app do not include a Windows licence unless a specific offer expressly states otherwise. This does not affect users’ rights under previously concluded agreements or their statutory rights.
This distinction does not restrict use of the app or restoration and, where applicable, sharing of purchases on supported Apple devices within the scope of the standard EULA, App Store rules and the terms of the relevant purchase.
2. Features and technical requirements
Downloading the app and using selected basic features is free. Advanced features may require a one-time purchase or an active subscription. Their specific content is described on the purchase screen.
The app requires a supported Apple device running iOS or iPadOS 17 or later. Certain features require internet access, a camera, motion sensors, notifications, CarPlay or other compatible equipment and system permissions.
3. Educational and unofficial nature
The app is solely an educational and training tool. The operator is not a driving school, examination authority or administrative body, and the app is not an official service of the Czech Ministry of Transport.
Tests, simulations, voice guidance, assessments, points and results are for practice and guidance only. They do not replace driving-school instruction or training, an official examination, professional assessment or the rules of actual road traffic. A successful result does not grant or confirm a driving entitlement.
Users must always rely on current regulations, instructions from authorised persons and the actual situation. The app must not be operated in a way that distracts from driving. In CarPlay, it is intended solely for safe listening to supported audio content.
4. Purchases and subscriptions
Apple processes purchases. Before a purchase is confirmed, the main features of the offering, the current price supplied by the App Store, the plan duration and any trial period are displayed. Payment is charged to the user’s Apple Account upon confirmation.
Monthly, quarterly and annual subscriptions automatically renew for the same period unless the user cancels them in their Apple Account settings. After cancellation, access remains active until the end of the paid period. A trial converts to a paid subscription when it ends unless cancelled in time. The one-time Premium purchase is not a subscription and does not automatically renew.
Purchases can be restored in the app. Apple handles refund requests, generally through reportaproblem.apple.com. This does not limit statutory consumer rights, including rights relating to distance contracts.
5. Digital content, updates and complaints
The operator will make content available without undue delay after verifying the purchase and will provide updates necessary to maintain functionality and security for the duration of the paid provision. Users should maintain a supported operating system and install available app updates.
Defects may be reported to support@jandobes.cz. Users should include a description of the problem, the app version and, where possible, purchase identification, but never their Apple Account password. Complaints concerning digital content will be handled within a reasonable time. Statutory rights to have the content brought into conformity, receive a price reduction or terminate the agreement remain unaffected.
6. Availability and changes
The operator aims to provide ongoing availability but cannot guarantee uninterrupted operation. Restrictions may arise because of maintenance, security, faults, changes in the law or unavailability of services provided by Apple, Google or other suppliers.
Features may be reasonably modified for security, technical development, corrections or legal compliance. A change must not deprive users of paid provision without a lawful basis. Users will be informed of significant adverse changes reasonably in advance.
7. External content
Some questions link to external animations, for example at etesty2.mdcr.cz. The external operator manages their content, availability and processing of network data. The app operator is responsible for identifying and technically providing the link only to the extent required by law.
8. Liability
The operator is responsible for the conformity of paid content with the agreement and for damage to the extent required by law. Nothing in these Terms excludes rights that cannot be contractually limited in relation to consumers.
The operator is not responsible for decisions in real traffic based on confusing a simulation with an actual situation, or for restrictions caused by an unsupported device or a service outside the operator’s control, unless the operator is legally responsible for those circumstances.
9. Rules of use and rights to content
The app is intended for personal education; the standard EULA determines the scope of the right to use it. Users must not bypass protection of paid features, disrupt operation, distribute unauthorised copies or infringe third-party rights.
Code, design, original texts, graphics and simulations are protected. Legislation and works that qualify as official works are used to the extent permitted by law. Third-party questions, photographs, animations, models and sounds may be subject to separate rights and licences identified in the app.
10. Privacy and iCloud synchronisation
Data processing is described in the separate Privacy Policy. Consent to optional analytics is not a condition of use and can be withdrawn at any time.
The app stores the profile, study progress and user content on the device. When synchronisation is enabled, supported data and settings are transferred through a private Apple iCloud / CloudKit database between devices using the same Apple Account. The transfer also includes saved regular simulator drive history with telemetry and user simulator preferences, custom test configurations and saved custom intersection animations, including their settings, assigned questions and preview images. The Privacy Policy describes the scope. iCloud is not required for local study and is independent of optional analytics. Screen recordings are not transferred by this feature and are not automatically sent to the operator.
Synchronisation requires an available iCloud account, an internet connection and sufficient storage. Offline changes wait until the necessary conditions are restored. The app merges concurrent changes; a newer change may take precedence for the same setting, custom test or animation. Edits and deletions of custom tests and animations are also synchronised. Before switching devices, we recommend checking synchronisation status in Settings. Synchronisation is not an archive of earlier states and does not transfer a drive or playback currently in progress.
Synchronisation can be disabled in Settings on each device. Disabling it stops further synchronisation on that device but does not erase local or previously stored cloud copies. Resetting supported progress may propagate to other devices; it is not complete erasure of personal data. The Privacy Policy describes how to request erasure and the limitations of current resets. Technical limitations of Apple services do not limit statutory consumer rights or data protection rights.
11. Minors
Persons under 15 may use the app only with the consent and supervision of their legal representative. A minor may make a purchase only to the extent permitted by law and Apple Account rules.
12. Changes to these Terms
These Terms may be amended because of changes in the law, features, suppliers or business model, or to clarify the text. A significant change will apply only after the new wording has been displayed and renewed acceptance requested. Existing rights and the paid period remain unaffected.
13. Governing law and out-of-court dispute resolution
Relations are governed by the laws of the Czech Republic without prejudice to mandatory consumer rights. If a dispute cannot be resolved by agreement, a consumer may refer it to the Czech Trade Inspection Authority, Štěpánská 796/44, 110 00 Praha 1, Czech Republic, coi.gov.cz/informace-o-adr.
